Thank you for your interest in the Communicative Access Measures for Stroke (CAMS) suite of surveys on institutional communicative access (the "CAMS Surveys") offered by the Aphasia Institute.
The results of the CAMS Surveys will be used to identify areas of success and areas that may need improvement within an organization using a CAMS Survey as well as generally across other organizations.
The content and administration of the CAMS Surveys has been reviewed and approved by the Quality, Research and Ethics Committee of the Aphasia Institute.
Participation is voluntary, and an individual completing a CAMS Survey may stop at any time.
These terms and conditions regarding the use of CAMS Surveys applies both to: (i) employers and other organizations that ask the Aphasia Institute to distribute and collect responses to a CAMS Survey (each a "Survey Commissioner"); and (ii) individuals who answer or otherwise respond to a CAMS Survey (each a "Survey Respondent").
PLEASE READ THESE TERMS CAREFULLY BEFORE YOU START TO USE OR RESPOND TO A CAMS SURVEY. BY USING OR RESPONDING TO A CAMS SURVEY, YOU ACCEPT AND AGREE TO BE BOUND BY THESE TERMS OF USE, INCLUDING THE APHASIA INSTITUTE PRIVACY POLICY. IF YOU DO NOT AGREE TO THESE TERMS, YOU MAY NOT ACCESS OR USE THE CAMS SURVEYS.
Privacy
All answers to a CAMS Survey will be kept confidential. Any personally identifiable information collected from a Survey Respondent, including any email address, will be kept on secure data servers by the Aphasia Institute, and will not be shared with any person or group. The Aphasia Institute will only use such personal information to present the CAMS Surveys to a Survey Respondent and for no other purpose.
Responses to a CAMS Survey may be used by the Aphasia Institute for the purpose of research or continued development of CAMS, but only aggregate results of a CAMS Survey, which do not include any personally identifiable information, or any individual responses, will be reported back to the Survey Commissioner.
Please review the terms of the APHASIA INSTITUTE PRIVACY POLICY, which are incorporated into these Terms by reference.
Confidentiality
The CAMS Survey questions and reports, and their design, selection and arrangement, are the confidential information of the Aphasia Institute. By partaking in a CAMS Survey, you agree to hold such confidential information in trust for the Aphasia Institute and in strict confidence. You agree not to use or reproduce such confidential information except for the purposes set out in these Terms and you will not create any derivative work from any CAMS Survey, or use them to develop any survey, software or competitive product or service.
License
The Aphasia Institute grants to each Survey Commissioner the non-exclusive license to reproduce, display, distribute and otherwise use any reports delivered by the Aphasia Institute to the Survey Commissioner, solely for the purposes of assessing and developing health equity plans, accreditation planning, service quality improvement initiatives and continuing education needs assessments related to stroke care in various healthcare settings.
Except as expressly stated in these Terms, the Aphasia Institute grants you no right or license, express or implied, to any of the CAMS Surveys, including any reports prepared by the Aphasia Institute and resulting from the CAMS Surveys.
Survey Commissioners can publish CAMS data reports for non-commercial reasons, but should acknowledge and recognize the Aphasia Institute.
Research
If you would like to use the CAMS suite of surveys for research purposes, please ensure compliance with your organization's requirements regarding research projects.
The Aphasia Institute requests that if you use CAMS survey data and/or reports for the purpose of a research project, please notify the Aphasia Institute at research@aphasia.ca.
Informed consents
Within the CAMS suite of surveys, managers and staff will be required to indicate informed consent prior to providing responses to any CAMS survey questions.
Staff who are assigned by a manager to facilitate the CAMS Patient Satisfaction Survey must obtain informed consent with patients/clients before facilitating the patient satisfaction survey. The staff assigned by a manager to facilitate the patient survey will gain access to pictographic resources and scripts – through their CAMS login – to help facilitate the informed consent and survey with patients/clients.
Organizations are responsible for securely locking up their own hard-copy files of patients'/ clients' informed consent forms and survey responses.
When staff prepare to enter responses from patient surveys into the CAMS online system, the system will prompt them to set up a Patient ID code. Staff cannot use full names or other identifying information when setting up the Patient ID code, to protect the privacy and confidentiality of patients/clients.
Staff will also be prompted by the CAMS online system to verify, before entering patient survey responses online, that informed consent was indeed obtained from the patient/client.
Intellectual Property Rights
The CAMS Surveys, including their entire contents, features and functionality (including but not limited to all questions, multiple choice answers, text, set-up and software design, videos, pictographs and images and their design, selection and arrangement), and all intellectual property rights in the CAMS Surveys, are owned by the Aphasia Institute or its licensors or other providers of such material.
Except as expressly authorised, you may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download or transmit any of the CAMS Surveys.
You hereby grant to the Aphasia Institute a royalty-free, perpetual, irrevocable, transferable, sublicenseable, worldwide, non-exclusive license in and to your responses to any CAMS Survey so that the Aphasia Institute can reproduce, store and use such responses for the purposes of delivering the CAMS Surveys and resulting reports, but subject always to the confidentiality and other obligations of the Aphasia Institute under these Terms.
Termination
Nothing in these Terms obligates the Aphasia Institute to deliver any CAMS Survey. The Aphasia Institute may terminate these Terms at any time in its sole discretion.
Disclaimer
The CAMS Surveys and results are provided for information purposes only and on an "as is" basis and there are no representations, warranties, covenants, or conditions, express or implied (including any implied warranties or conditions of merchantable quality or fitness for a particular purpose and those arising by statute or otherwise in law or from a course of dealing or usage of trade), including, but not limited to, non-infringement, correctness, functionality, reliability, accuracy, operation, use or the results of the use by any person, or that the CAMS Surveys will be error-free or that they will meet your requirements, all of which are expressly denied and disclaimed to the maximum extent permitted by law.
Limitation on Liability
IN NO EVENT WILL THE APHASIA INSTITUTE, ITS AFFILIATES OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE CAMS SURVEYS, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT OR OTHERWISE, EVEN IF FORESEEABLE.
General
These Terms, including the APHASIA INSTITUTE PRIVACY POLICY, constitute the sole and entire agreement between you and the Aphasia Institute with respect to the CAMS Surveys and supersede all prior and contemporaneous understandings, agreements, representations and warranties, both written and oral. All matters relating to the CAMS Surveys and any dispute or claim arising from them or related to them, are governed by and will be construed in accordance with the laws of the Province of Ontario and the laws of Canada applicable in Ontario. You hereby attorn to the jurisdiction of the courts of the Province of Ontario and of the Federal Court of Canada and waive any objection to venue or any claim of inconvenient forum.
